§ 1. Subject Matter
Twohappy GmbH (hereinafter: "Seller") sells admission tickets to the event Giegling am See taking place from 9–12 July 2026 in Stare Resko, Poland (hereinafter: "Event"). The ticket entitles one person to access the Event venue and participate in all parts of the programme for its entire duration. The ticket is personal and may not be resold or transferred to third parties.
§ 2. Order and Payment
An order is placed upon purchase confirmation in the online shop. The ticket price is EUR 260.00 and includes all applicable taxes. Payment must be made promptly after placing the order and no later than 14 days from the order date. Failure to pay within this period results in automatic cancellation of the order at no cost to the buyer. The payment date is the date on which the Seller's account is credited.
§ 3. No Right of Withdrawal
No right of withdrawal applies. The contract concerns the provision of a leisure and entertainment service — admission to the Event — for which the contract specifies a fixed date of performance: 9–12 July 2026. Exclusion basis: Art. 38(12) of the Polish Consumer Rights Act of 30 May 2014 and § 312g(2) no. 9 of the German Civil Code (BGB). This exclusion applies regardless of the buyer's place of residence within the EU.
§ 4. Change of Contracting Party — Assignment to 99 Dębów
The Seller is entitled to transfer all rights and obligations arising from this contract, including the obligation to provide access to the Event, to „99 DĘBÓW" Spółka z ograniczoną odpowiedzialnością (a Polish private limited liability company, in formation or after registration) with its registered office at Stare Resko 10, 78-320 Stare Resko, Poland, e-mail: 99oaks@gmail.com (hereinafter: "99 Dębów").
By making a purchase, the buyer expressly consents to such transfer pursuant to Art. 519 § 2 point 2 of the Polish Civil Code, with effect from the moment of written or electronic notification of the buyer that the transfer has taken place. Upon the transfer becoming effective, 99 Dębów assumes all rights and obligations of the Seller towards the buyer, and the Seller is released from them. The transfer does not affect the scope of the service owed to the buyer or the ticket price.
§ 5. Event Rules
The conditions of participation in the Event, including access and conduct rules for the venue, are set out in the separate on-site event rules available at the venue entrance on the opening day of the Event. By purchasing a ticket, the buyer undertakes to read and comply with the event rules.
§ 6. Data Protection
Controller. The controller of the buyer's personal data is Twohappy GmbH, Köpenicker Chaussee 11–14, 10317 Berlin, Germany, e-mail: tickets@twohappy.net.
Purpose and legal basis. Data (name, e-mail address, order information) are processed for the performance of the contract — Art. 6(1)(b) GDPR — and for the establishment or defence of legal claims — Art. 6(1)(f) GDPR.
Data transfer. In the event of assignment of the contract to 99 Dębów, the buyer's data will be transferred to that entity as necessary for performance of the contract; from that moment 99 Dębów becomes an independent controller of the data for the purposes of ticket fulfilment.
Your rights. The buyer has the rights set out in Arts. 15–21 GDPR, including the right of access, rectification, erasure and objection. No data transfers outside the EEA. The buyer has the right to lodge a complaint with the competent supervisory authority.
§ 7. Governing Law and Jurisdiction
This contract is governed by Polish law. Consumers habitually resident in the EU retain the protection afforded by the mandatory consumer protection provisions of their country of residence. The competent court is the court having jurisdiction over the Seller's registered office; consumers may also bring proceedings before the court of their place of domicile (Art. 18 Brussels Ia Regulation).
